One of the major hurdles Apple's Sherlock had to cross was preserving the ad revenue of the search engines, which Apple did by obtaining licensing agreements with the engines, and designing the protocol to preserve the ads. AOL might be receptive to an MS proposal that required that MS carry AOL's ads in such a way that AOL could retain their revenue. If MS isn't interested in this, then it certainly clarifies their position. A protocol that preserved ad revenue streams could still be open.
