By shifting responsibility onto the non-patent holders to overturn a bad patent, no matter how much you distribute it, it's still the patent holder exerting control. That the level of control is finite is no surprise; but while in theory it's "only a matter of a court challenge" to overturn a patent, reality has shown it to be a complicated affair when the patent holder has lots of money, even if you don't count the fact that the patent sure does sound amazing to Judge "I've seen them new-fangled computer things at Sears" Fogey.
