It descriminates against proprietary software, not commercial. Most commercial code is proprietary, but not all of it. And not all proprietary code is commercial.

Since both the DFSG and the "Open Source" definition were both designed specifically to include BSD, XF86, and GPL, I doubt it would fail to pass the test.

You misread the GPL. If you own the code, even if you GPL it, you have full rights to make changes to it and sell it and to not release the source. However if someone else uses your work they can't. You also can't close the work of others.
