Yes, the mechanism needs to be designed to keep the honest users honest so that they get to respect the wishes of the site's owner. It's not going to keep hackers from linking anywhere in your site.

Anyways, with such a mechanism in place, the site's owner is in a much better position to sue when she is violated.
