Open source does not trump patents. The freeze in MP3-related technology is not just coming from music industry, it's also coming from a patent held by a German company who is ruthlessly enforcing it.

Open source isn't an automatic solution for the patent problem; however, the Ogg Vorbis project is developing an open source (LGPL) and patent-free audio CODEC, with promising results. Routing around the Fraunhofer patent.
