What has happened to at least the notion of separation of church and state?

I feel this is strongly related to another issue that's finally getting focus – patents, copyright law, intellectual property...

Weren't the original provisions meant to protect exactly what they now hinder... progress, knowledge-sharing, etc?

Everyone is stupid... but perhaps we can improve our collective intellect one step at a time.
