It's kinda hard for anyone to sit back and say, "Ah shucks, someone slipped their NDA and the news got to a journalist so now there's nothing I can do about it because of the first amendment."

It's a lot like Napster, once the information is out of your hands there's not a thing you can do about it but hope for the kindness of strangers. In the case of Apple rumor-mongering, there is not enough kindness to Apple to go around -- we want the the news and there are people willing to share it gladly.
